The ex-lawyer for the former president has stepped down as the US Attorney for New Jersey. This comes after a legal ruling that invalidated her legal standing to serve.
Official Departure
The head of the Justice Department, the Attorney General, confirmed the prosecutor's departure on the start of the week. She commented that the appeals court finding made it unworkable for her to effectively run her office.
"But do not mistake compliance for surrender," she wrote. "The effort will now reach across America."
Legal Background
Habba's exit comes a week after a federal appellate panel ruled that she had been serving in violation of the law as the federal prosecutor. This ruling is expected to impact scores of prosecutions in the state.
The judicial panel ruled that a temporary posting that skirted Senate approval violated the Federal Vacancies Reform Act.
Ongoing Legal Battle
Bondi said that the former prosecutor will stay on at the Department of Justice as a senior adviser. Habba plans to pursue additional appeals of the disqualification, with hopes of a reversal.
In a statement, Bondi contended that the judiciary "should not be able to countermand the executive's selection of lawyers entrusted with carrying out the primary duty of the administration of criminal prosecution."

The attorney general praised her tenure and pointed out that while she was in charge, the state capital of Newark saw a 20% reduction in criminal activity. It was also reported that the Camden recorded its first summer in half a century with no murders.
Connection to Donald Trump
Habba, 41, was initially recruited to the former president's legal defense in 2021. Subsequently, she represented the former president in his hush-money trial in the previous year, when he was guilty verdict on dozens of charges of financial record manipulation.
Prior to Habba took on the top New Jersey post, Trump had stated he was appointing her as his presidential counsellor in a potential future term, labeling her as a steadfast ally and a "tireless advocate for justice".
