The ex- leader's administration on Monday requested the nation's highest court to allow the removal of the director of the American copyright authority.

This urgent appeal follows about six weeks after a national appeals court in Washington decided that the director, Shira Perlmutter, cannot be unilaterally fired.

Almost four weeks prior, the entire District of Columbia circuit court refused to reconsider that decision.

This legal matter is the latest in a series of cases related to presidential authority to appoint chosen heads at government agencies.

The High Court has generally permitted such actions, even as court challenges proceed.

However, this particular case concerns an bureau within the national library. Perlmutter acts as the register of copyrights and also counsels Congress on intellectual property matters.

The solicitor general, D John Sauer, argued in the legal document that, despite ties to Congress, the register “exercises executive power” in overseeing copyrights.

Perlmutter claims she was terminated in May because the ex-leader disagreed with recommendations she gave to Congress in a document concerning AI.

She reportedly got an message from the administration informing her that her position was “ended effective at once,” as stated by her staff.

A divided appellate group ruled that Perlmutter could keep her position while the case moves forward.

“The Executive's alleged blatant meddling with the work of a congressional official, as she carries out statutorily authorized duties to advise the legislature, appears to be a violation of the separation of powers,” wrote Judge Florence Pan for the appeals court.

Judge J Michelle Childs joined the ruling. Both judges were appointed to the appeals court by Democrat leader Joe Biden.

In opposition, Judge Justin Walker, a former president's nominee, wrote that Perlmutter “uses administrative authority in a host of manners.”

Perlmutter's attorneys have contended that she is a well-known copyright specialist. She has served as copyright director since former head librarian Carla Hayden selected her to the role in October 2020.

The former president named assistant attorney general Todd Blanche to replace Hayden at the national library. The White House had dismissed Hayden following criticism from conservatives that she was promoting a “woke” agenda.
