Michael Jordan Testifies He ‘Wasn’t Afraid’ of the Racing Body in Antitrust Trial
The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, stated that his drive to win and novelty within the sport motivated his push for 23XI Racing to “challenge” Nascar over alleged violations of competition laws.
Financial Stakes and a Will to Win
The owner disclosed operational insights of his racing venture, saying he invested $40 million of his own funds into the Nascar Cup series team launched with partner Polk and driver Hamlin.
“It fell to someone to act,” Jordan said during testimony. “As a newcomer, I had no fear. I believed I could take on Nascar as a whole. I felt as far as the sport it needed to be looked at through a new lens.”
Central Issue: Franchise System and Renewal Demands
The heart of the case involves the end of a 2016 deal where Nascar provided each team a “charter”. This system mirrors other professional sports with separately owned franchises, such as the Charlotte Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar insisted on teams renew their charters.
Jordan testified for about sixty minutes and exited the courthouse to pandemonium, with onlookers and reporters clamoring for a view or a photo of the sports legend.
Spearheading the Fight
23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to change a operating model Jordan said is breaking the law to keep two hands on the wheel.
At issue for Jordan and a fellow team representative, who preceded Jordan, are events from last September. Gibbs described a frantic and emotional six hours where the racing circuit told teams they must sign a charter agreement extension. The document consists of 112 pages outlining team compensation and a guaranteed spot in every race.
Choosing Litigation
Jordan explained that his team and its ally concluded their only feasible option was to decline to sign that extensive document and take the issue to court. The other 13 organizations agreed to the terms.
The team owners approached Nascar about possible changes or negotiations. Nascar wasn’t talking, Jordan said.
The Ultimate Motivation: Winning
But in the end, the pushback against what he saw as a unsustainable system was mostly about the familiar goal for Jordan: Success.
“Hamlin persuaded me getting a third driver boosted our odds of winning,” he said, noting that he bought a third charter late in 2024 for $28 million amid the legal dispute. “So I took the plunge.”
Heather Gibbs’ Testimony
Heather Gibbs detailed her push for indefinite franchises, which she said a written letter to Nascar. She testified the pressure of the signature deadline was problematic.
According to her, the team founder first tried to call and persuade Nascar against demanding signatures, but Nascar’s leader declined the request.
“Don’t do this to us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. She said France replied, “If I wake up and I have 20 charters, I have 20. If I have 30, I have 30.”
