US Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody

A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The situation originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to face human smuggling charges, he was detained in federal custody.

In her order, the court noted that the government lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."

Background of the Case

The legal proceedings center on conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in the state of Tennessee.

Conditions of Freedom

The court, who was hearing his challenge to deportation in a Maryland district court, determined that he must now comply with the terms of his bond from jail in Tennessee. This decision shifts his monitoring to the Tennessee court.
